What Is the TSE Compliance Process 2026?

The TSE compliance process 2026 refers to the full set of obligations surrounding the Technical Security Device (TSE) for electronic cash registers in Germany. The legal basis is §146a AO in conjunction with the Kassensicherungsverordnung (KassenSichV). Since January 1, 2020, every electronic POS system in the hospitality industry must use a certified TSE, sign every transaction in a tamper-proof manner, and be fully exportable during any cash register audit. In 2025 and 2026, three new obligations are being introduced: the mandatory registration via Mein Elster, the expiry of first-generation hardware TSE certificates, and stricter cash register audits.

The Three Deadlines in 2025/2026

Three key dates determine whether your POS system will still be legally compliant in 2026. Miss one and you risk estimated tax assessments, fines, or — in the worst case — an operational shutdown during the next cash register audit.

  1. Deadline: July 31, 2025 Critical

    Mandatory registration with the tax office via Mein Elster

    All electronic POS systems acquired before July 1, 2025 had to be registered with the responsible tax office via the Elster portal by July 31, 2025. Since then, every new system must be registered within one month of commissioning (§146a para. 4 AO). If you missed the deadline, you should file the registration now — retroactive submissions without triggering an audit flag are often still possible.

  2. Period: 2025–2026 Warning

    Expiry of first-generation hardware TSE certificates

    The BSI-certified first-generation hardware TSE modules (installed 2019–2021, including Swissbit, Diebold Nixdorf, Epson) have a lifespan of 5 years. The first certificates expired in 2024, with the major installation waves following in 2025 and 2026. Once the certificate expires, the POS system can no longer generate valid receipts — until the module is replaced or you switch to a cloud TSE.

  3. From: January 1, 2026 Important

    Stricter cash register audits and KassenSichV compliance checks

    Starting in 2026, the tax authorities are shifting their audit focus from formal receipt checks to practical on-site inspections: test purchases, receipt verification, DSFinV-K exports, and TSE evaluation directly at the POS system. At the same time, the reduced VAT rate on food (7%) is being permanently established — tariffs must be correctly configured in the POS system.

Six-Step Compliance Check

Work through these six items in order. Two of them you can handle immediately — for the others, a conversation with your POS provider or tax advisor is usually sufficient.

  1. Verify your POS system's §146a AO compliance

    Have your provider confirm in writing that your system meets the requirements of §146a AO, KassenSichV, and DSFinV-K. Without this confirmation, every tax audit is a risk.

  2. Check your TSE certificate expiry date

    Determine whether you are using a hardware TSE (Swissbit, Epson, Diebold) or a cloud TSE. For hardware: check the certificate expiry in the TSE report. Cloud TSE renews automatically; hardware must be replaced manually.

  3. Complete registration with the tax office via Mein Elster

    Log in to Mein Elster → select the form 'Notification of electronic recording systems' → enter your tax number, system type, TSE serial numbers, and acquisition date. The registration is free and takes less than 15 minutes.

  4. Activate the receipt issuance obligation

    Every transaction requires a receipt — digital (QR code, email) or on paper. Verify that the receipt contains the TSE signature, transaction number, and start/end times. If any of these is missing, the receipt is formally deficient.

  5. Update your procedural documentation (VDoc)

    Document in writing which system, which TSE, which cloud provider, and which archiving strategy are in use. Without up-to-date procedural documentation, you risk estimated tax assessments under §162 AO during a cash register audit.

  6. Train your staff on cash register audits

    Your team needs to know: Who is authorized to inspect? Which exports (DSFinV-K, Z-report) must be provided? How do I respond to a test purchase? A 30-minute briefing prevents costly mistakes in a real audit.

Fines for Non-Compliance

The financial risks are real: §379 AO classifies cash register deficiencies as administrative offenses, §370 AO as tax crimes. The amount depends on the duration and severity of the violation.

What is the TSE process and who is affected?

The TSE process encompasses all obligations surrounding the Technical Security Device (TSE) for electronic cash registers. Every commercial business with an electronic POS system is affected — including restaurants, cafés, snack bars, bakeries, food trucks, retail shops, and service providers. Only businesses using exclusively an open cash drawer (with manual counting strips) are exempt.

By when do I need to register my POS system with the tax office?

The initial registration of all systems acquired before July 1, 2025 had to be completed by July 31, 2025. You have two options: either replace the hardware module with a new one (cost: approx. €200–400) or switch to a cloud TSE, where certificates renew automatically. For newcomers, cloud TSE is usually cheaper and lower maintenance.

What penalties apply for a missing TSE under §379 AO?

The law provides for fines of up to €25,000 per violation under §379 para. 1 AO. In addition, systematic violations can trigger criminal tax proceedings under §370 AO. In practice, a discovered TSE gap often escalates to a full tax audit with estimated assessments under §162 AO — which can be financially far more severe than the fine itself.

Does the receipt issuance obligation also apply to snack bars and food trucks?

Yes. The receipt issuance obligation under §146a para. 2 AO applies to every electronic POS system, regardless of business size or type. Exemptions are only possible upon application to the tax office (§148 AO), for example for sales to a large number of unknown persons outdoors — but the bar is high. In practice, snack bars, food trucks, and market stalls should expect to be required to offer receipts.

How does the Mein Elster registration work step by step?

First: log in to Mein Elster (or register — this can take up to 14 days). Second: search for the form 'Notification of electronic recording systems'. Third: enter your tax number, system type (POS type + manufacturer), TSE type and serial number, acquisition or lease date, business location, and number of devices per location. Fourth: submit and save the confirmation. The entire process takes less than 15 minutes per system.

What does the tax office check during a cash register audit in 2026?

The cash register audit under §146b AO is an unannounced on-site inspection. Auditors typically request: current procedural documentation, TSE exports, DSFinV-K datasets from recent days, void transactions, training transactions, and Z-reports. Additionally, auditors conduct test purchases and compare the issued receipt against the digital record. Gaps lead directly to a full tax audit.
